Misdemeanor Judgments in Kuwait: Appeal, Objection & Enforcement

 

A concise practical guide based on the provisions of the Code of Criminal Procedure and Trials and its latest amendment, with reference to distinguishing misdemeanor judgments that are not subject to immediate enforcement.

Summary

Offences in Kuwait are classified into felonies, misdemeanors, and contraventions according to the severity of the penalty. Misdemeanor judgments are issued at first instance by the Misdemeanor Court and may be challenged subject to specific conditions. Following the amendment of Article (201), the appeal period is 30 days running from the date the judgment is pronounced where it is rendered in the defendant's presence or upon objection, and from the date a judgment in absentia becomes no longer open to objection. An objection against a misdemeanor judgment rendered in absentia must be filed within one week of service of the judgment. As a general rule, misdemeanor judgments are not enforced until they become final, unless immediate enforcement is prescribed by law or ordered by the court with stated reasons in specific cases.

1) Definition and Classification of Misdemeanors

A misdemeanor is an offence punishable by imprisonment not exceeding a certain limit, or by a fine, or by both. The legislative classification rests on the Penal Code and the complementary provisions of the Code of Criminal Procedure and Trials.

General rule: The classification carries significant procedural consequences for the methods of challenge, their time limits, and the enforcement of judgments.

2) Jurisdiction and the Judicial Structure for Misdemeanors

First-instance judgments

These are heard by the Misdemeanor Court (a bench of the Court of First Instance), which issues judgments either in the defendant's presence or in absentia, depending on the defendant's attendance.

Appeal judgments

These are heard before the Misdemeanor Court of Appeal (three judges of the Court of First Instance). The procedures and time limits are governed by the rules laid down in the Code of Criminal Procedure.

3) Objection to Judgments Rendered in Absentia (Misdemeanors)

Where a judgment is rendered in absentia, the defendant may file an objection within one week from the date of service of the judgment, subject to the prescribed conditions. The court then rules on the objection; if the objecting party appears, their pleas are heard and a judgment is issued, that judgment on objection becomes the subject of any subsequent challenge.

Effect of missing the deadline: If the one-week objection period lapses without action, the only remaining route for the defendant is appeal, where the judgment is open to it.

4) Appeal in Misdemeanors and Its Time Limit (Article 201 as amended)

The legislator amended the appeal period, providing that the appeal period is thirty (30) days:

  • Judgment rendered in the defendant's presence or upon objection: the period runs from the date the judgment is pronounced.
  • Judgment in absentia: the period runs from the date it becomes no longer open to objection, following valid service and the lapse of the one-week objection period without its use.
Key provision: Article (201) of the Code of Criminal Procedure and Trials as amended.
Filing the appeal: The petition is submitted to the registry of the court that issued the judgment and is signed by the appellant or their representative. If the defendant is in custody, it is submitted through the prison warden (a procedural provision following Article 201).

5) Scope of Appealability of Misdemeanor Judgments

  • Judgments imposing a very minor fine: where the fine does not exceed a certain threshold, the convicted party may not be entitled to appeal it, while the civil claimant retains the right of appeal (in accordance with the rule set out in the chapter on appeals in misdemeanors).
  • Acquittals: the claimant may appeal an acquittal in a misdemeanor case.
  • Otherwise: as a general rule, misdemeanor judgments are appealable by both parties, subject to the applicable conditions.
Practical advice: Before deciding whether an appeal is worthwhile, review how the judgment is characterised (presence / absentia / objection), the type of penalty and its amount, and verify precisely how the time limit runs.

6) Cassation in Brief

Cassation is an exceptional route whose grounds are exhaustively defined by law (violation of the law, error in its application or interpretation, material nullity…). Its time limits and conditions are set out in specific provisions. Cassation is admissible, for those misdemeanor judgments that allow it, once they have been issued by the Court of Appeal.

Rule: The cassation period differs from the appeal period and runs from the date the appeal judgment is pronounced, where the judgment is of a type open to cassation.

7) Enforcement of Misdemeanor Judgments and Immediate Enforcement

First: the general rule on enforcement

As a general rule, compulsory enforcement of misdemeanor judgments takes place only after they become final (acquiring the force of res judicata) through the lapse of the periods for challenge or the determination of such challenges.

Second: when is immediate enforcement ordered?

  • Where the law expressly provides for immediate enforcement of a particular category of judgments.
  • Or where the court orders the judgment to be immediately enforceable for serious reasons supported by stated grounds (such as the risk of the convicted party absconding, or a manifest public interest).
Practical indicator that a judgment is not subject to immediate enforcement: the absence of any express legislative or judicial provision ordering immediate enforcement, together with the judgment remaining open to challenge and that challenge being pursued within its time limits.

Third: general outline of enforcement procedures

  • Imprisonment is enforced by a written order to the prison authority, accompanied by a copy of the judgment.
  • Matters such as the calculation of custody, physical coercion, and the like are regulated in the chapter on criminal enforcement.

8) Practical Guidance and Brief Scenarios

Scenario: a misdemeanor judgment in absentia

  • Verify that the judgment was validly served.
  • File the objection within one week; otherwise proceed directly to appeal (where it is admissible).
  • Track the 30-day appeal period running from the date the judgment becomes no longer open to objection.

Scenario: a judgment imposing a fine, rendered in the defendant's presence

  • Check the amount of the fine and the provision governing appealability.
  • If appealable: file the appeal petition within 30 days of pronouncement.
  • Request a stay of enforcement where appropriate, if there is a statutory or judicial basis for it.
